This actually falls into a "grey" area.
Are you leasing the Optus servers? Are Optus paying Alphawest to
manage the software for them?
Is Alpahwest still listed as a legal company? - ie does it still
operate a separate set of accounts and separate tax return. From a
search on the ASIC web site it does appear to.
The actual ownership of the company is not an issue - the license is
issued to a specific company for use by that company. Therefore the
Optus license can be used by Optus only.
If Alphawest want to use the software and they are a separate legal
entity then AlphaWest would need to purchase their own license.
Is there someone at Optus who can corroborate your position?
